GENERAL INFORMATION FOR ALL USERS
The following terms represent a binding agreement between you, the user, and JobsInTrucks.com.
INTRODUCTION
Please read this page carefully. It contains the terms and conditions (the "Terms and Conditions") governing your access to and use of the JobsInLogistics.com Inc. websites, which include JobsInLogistics.com, JobsInTrucks.com, AllRetailJobs.com, JobsInManufacturing.com and FleetJobs.com. If you do not accept these Terms and Conditions, or you do not meet or comply with their provisions, you may not use the JobsInLogistics.com Inc. websites.
1. ENTIRE AGREEMENT:
This Agreement, as amended from time to time, including the terms of use, constitute the entire agreement between the parties, and all prior or other agreements or representations, written or oral, are superseded.
a. JobsInTrucks.com reserves the right to modify the terms and conditions of this agreement or provide additional usage requirements in its sole discretion at any time by posting a revised version hereof. Your continued use of the site after the revised changes constitutes your acceptance to the revisions.
b. Usage of JobsInTrucks.com including registering, searching or posting jobs, and searching or posting resumes, implies acceptance of these terms and conditions.
2. LIABILITY:
We assume no liability or responsibility for the content submitted by the users of this site. JobsInTrucks.com is not responsible for the accuracy of posted jobs and or posted resumes.
a. Advertisers and Users of JobsInTrucks.com retain the sole responsibility for content of adverts and resumes and all applicable laws, regulations and standards.
b. All employers, recruiters, agencies and job seekers posting adverts or resumes on this site must adhere to the requirements of the Equal Employment Opportunity Commission (EEOC) as well as commonsense business ethics. This includes: No obscene, discriminating, libelous, defamatory, sexually explicit, misleading or false information.
c. JobsInTrucks.com is not a placement agency or recruiting firm and we do not guarantee that jobs or resumes posted will result in candidates being contacted or hired or jobs filled.
d. All contents on this site, including the job and resume database, are the sole property of JobsInTrucks.com.
e. The unauthorized use of spiders, robots, or any other such device to navigate or search any area of this website is prohibited.
f. JobsInTrucks.com reserves the right to deny or suspend the services of this site to any individual for any reason.
3. COPYRIGHT:
All site Content, including logos, text, graphics, software, animation, Search Engine and Databases are the sole property of JobsInTrucks.com, and are protected by U. S. and International copyright laws. You may not reproduce, modify, display, distribute or sell the content. This also applies to HTML code used to generate Web pages on JobsInTrucks.com.
4. NO WARRANTIES:
To the fullest extent possible by law, JobsInTrucks.com does not warrant that any JobsInTrucks.com site or any JobsInTrucks.com services will operate error-free or that any JobsInTrucks.com site and its servers are free of computer viruses or other harmful mechanisms. If your use of any JobsInTrucks.com site or the JobsInTrucks.com content results in the need for servicing or replacing equipment or data or any other costs, JobsInTrucks.com is not responsible for those costs. The JobsInTrucks.com sites and JobsInTrucks.com content are provided on an "as is" basis without any warranties of any kind. JobsInTrucks.com, to the fullest extent permitted by law, disclaims all warranties, whether express or implied, including the warranty of merchantability, fitness for particular purpose and non-infringement. JobsInTrucks.com makes no warranties about the accuracy, reliability, completeness, or timeliness of the JobsInTrucks.com content, services, software, text, graphics, and links.
5. DISCLAIMER OF CONSEQUENTIAL DAMAGES:
To the fullest extent possible by law, in no event shall JobsInTrucks.com, its suppliers, or any third parties mentioned on any JobsInTrucks.com site be liable for any damages whatsoever (including, without limitation, incidental and consequential damages, lost profits, or damages resulting from lost data, lost employment opportunity or business interruption) resulting from the use or inability to use any JobsInTrucks.com site and the JobsInTrucks.com content, whether based on warranty, contract, tort, or any other legal theory, and whether or JobsInTrucks.com is advised of the possibility of such damages.
6. PRIVACY:
JobsInTrucks.com is committed to protect the privacy of our users. We use our best efforts to ensure that any information you provide will remain private and confidential. JobsInTrucks.com is not responsible for any action that an employer may take should they find an employee's resume in the resume database. JobsInTrucks.com obtains personal information from Job Seekers, Companies and Recruiters on a voluntary basis only. The information allows us to store resumes and jobs in our secure database. The user decides which information to display.
When you give JobsInTrucks.com contact information (such as your name, email address and phone numbers) and other forms of personal and non-personal data, you agree that we may utilize this information for the purposes of assisting you in finding employment and to help employers find candidates. In particular. we may share your personal information with employers and recruiters so that they can contact you via telephone, fax, email, postal mail or any other means, and offer you opportunities for employment. To achieve this, we use your resume to share with registered employers and recruiters who pay for access to the resume database and job matching services. Also, JobsInTrucks.com may send you emails with employment guidelines, career advice as well as industry information as part of its services to you.
JobsInTrucks.com ensures compliance with telemarketing regulations and maintains strict boundaries on how user information is utilized:
1. No Sharing of Phone Numbers for Telemarketing: We do not share candidate phone numbers or engage in telemarketing practices.
2. Consent-Based Contact: All candidate interactions require explicit consent. No unsolicited communications are sent.
3. Client Obligations: Clients accessing the resume database must adhere to telemarketing laws and ensure compliance in their communication practices.
WE DO NOT SELL OR GIVE AWAY USER'S PERSONAL INFORMATION.
7. GOVERNING LAW AND JURISDICTION:
The provisions of this Agreement and the legal relations between the parties arising out of this Agreement will be governed and construed in accordance with the laws of the State of Florida. Guarantor hereby irrevocably and unconditionally submit to the jurisdiction of any court of competent jurisdiction located in the County of Miami-Dade, State of Florida in any action arising out of or relating to this Agreement and you hereby irrevocably and unconditionally agree that all claims with respect to such action or proceeding may only be heard in a court located in the County of Miami-Dade, State of Florida. You and JobsInTrucks.com hereto irrevocably and unconditionally waive any forum non-conveniens objection that either of them may have to suit arising out of or relating to this Agreement being venued in the County of Miami-Dade, State of Florida.
8. TELEMARKETING COMPLIANCE
JobsInTrucks.com adheres to all applicable laws, including FCC regulations, and requires all users, clients, and third-party traffic sources to comply with telemarketing laws.
a. Client Responsibility for Compliance: Clients utilizing JobsInTrucks.com must ensure their marketing and communication practices comply with all applicable telemarketing laws, including those related to texts, phone calls, and automated communications. Clients agree to refrain from using telemarketing practices to contact candidates unless explicitly permitted by law.
b. Traffic Source Compliance: JobsInTrucks.com does not control or guarantee compliance of third-party traffic sources. Clients acknowledge that any leads generated through third-party sources must comply with relevant telemarketing laws.
c. No Direct Communication via Text or Phone: JobsInTrucks.com does not engage in telemarketing practices, including phone calls or text messaging. Candidate communication is limited to email interactions.
d. Candidate Consent - JobsInTrucks.com ensures that candidates provide explicit consent before being added to the system or contacted by clients. Candidates must apply directly through the platform.
e. Indemnification Clause: Clients agree to indemnify and hold harmless JobsInTrucks.com against any claims arising from non-compliance with telemarketing laws and from any claims, damages, or liabilities resulting from non-compliance with telemarketing regulations or unlawful telemarketing activities conducted by the client.
9. LIMITATION OF LIABILITY:
Any liability of JobsInTrucks.com, whether to you or any other party for any direct, indirect, incidental, consequential or exemplary damages arising out of or relating to this agreement, whatever the basis of the liability, shall not exceed an aggregate of $100.00. This limitation is cumulative and not per claim. Neither JobsInTrucks.com, JobsInLogistics.com Inc. nor their agents, officers, directors or employees shall be liable for indirect, special or consequential damages.
EMPLOYERS, RECRUITERS AND AGENCIES
1. RESUME SEARCH POLICIES:
a. All subscribers to the Resume Search must be bonafide Employers and/or Recruiters. The resume database is to be accessed and used solely by the individual subscriber, for internal use only, for the purpose of recruiting candidates for open job opportunities. You may not distribute, sell or disclose any resumes to third parties. You may not provide your username and password or otherwise permit access to the resume database to any other party. You may view resume details, one at a time, up to a maximum of 100 resumes per day with an overall limit per license, dependent of contract type: Monthly - 300 resume views; Quarterly - 750 resume views; Semiannually - 1,250 resume views; Annually - 2,500 resume views.
b. Candidates' privacy must be respected at all times. Telemarketing practices, including unsolicited phone calls or text messages, are strictly prohibited. Clients may only contact candidates for legitimate job openings via permissible communication methods. Unsolicited telemarketing calls, texts, or automated messaging to candidates are prohibited. Clients must ensure compliance with all applicable telemarketing regulations.
c. We do not allow access to the resume database to any other job board, nor to any persons representing or acting as agents for any other job board. Unauthorized copying of job postings to post on other job boards is not permitted. Copying resumes or e-mail addresses to solicit traffic to other job boards is strictly prohibited and will result in appropriate legal action. Only bona-fide candidates can apply to the positions on our board. We do not allow other job boards or recruiters to waste the time of our customers by attempting to use this board to solicit their services. Any entity that violates the provisions contained in this paragraph agrees to pay JobsInTrucks.com a fine in the amount of $35,000.00 per occurrence, plus reasonable attorneys' fees and costs, within five (5) days after receipt of written notice from JobsInTrucks.com or its representative(s) describing the violation in question.
2. JOB POSTING POLICIES:
a. Each job posting is for a unique position. Job titles listing multiple positions are not permitted. JobsInTrucks.com reserves the right to alter job postings that do not comply with the 'single position' posting policy or any other violation of our posting policies.
b. The job posting services are to be accessed and used solely by the subscriber, for internal use only, for the purpose of recruiting candidates for open job opportunities.
c. The City field in a job posting must be ONE actual City and not general location phases such as ' Anywhere in USA.'
d. Submitting or posting hyperlinks or HTML code is not acceptable except in data fields that specifically request such data.
e. No account, including national accounts, can exceed 250 active job postings per user, per month.
3. PAYMENT TERMS:
Payment Terms: All payments are to be paid in US Dollars. Employers, Recruiters and Agencies agree to pay JobsInTrucks.com the applicable fees for the services provided. ALL SALES ARE FINAL. JobsInTrucks.com invoices serve as a binding contract for payment. You are responsible for the actions of your employees, agents and contractors while in your employ. Payment by invoice is due 14 days from date of purchase. Invoices 30 days past due accrue a 1.5% per month interest charge. Customer is responsible for any fees resulting from non-payment, including but not limited to reasonable attorney fees and/or collection fees. JobsInTrucks.com reserves the right to revise job posting fees, resume search subscription fees and other product charges without prior notice.
4. CREDIT CARD SECURITY:
JobsInTrucks.com uses the highest level of encryption to ensure the security and safety of your credit card information. Your credit card information is not saved in our database. THIS IS FOR YOUR PROTECTION.
5. BANKRUPTCY:
You will immediately notify JobsInTrucks.com of any bankruptcy, receivership, insolvency or similar action or proceeding initiated by or against you or any of your principals. You will include JobsInTrucks.com on the list and matrix of creditors as filed with the Bankruptcy Court, whether or not a claim may exist at the time of filing. Failure to comply with either of these requirements will be cause for immediate termination or any other action available to JobsInTrucks.com under applicable Rules or Law.
6. SEVER ABILITY AND WAIVER:
If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, unenforceable, or illegal, the invalidity of that provision will not affect any of the remaining provisions and this Agreement will be construed as if the invalid, unenforceable or illegal provision is not contained in the Agreement. Neither the failure nor delay by JobsInTrucks.com to exercise, or partial exercise of, any right under this Agreement will operate as a waiver or estoppel of such right, nor shall it amend this Agreement. The waiving party must sign all waivers.
7. ATTORNEYS' FEES:
You will be liable for and will indemnify and reimburse JobsInTrucks.com for any and all attorneys' fees and other collection costs and expenses incurred at or before Trial and in any Appellate proceeding paid or incurred by JobsInTrucks.com or their agents in the enforcement of this Agreement, or in collecting any amounts due from you or resulting from any breach by you of this Agreement.
